Article 12 requires REALTORS® to present a true picture in advertising, marketing, and other representations. This means staged images must be disclosed and cannot misrepresent the property's actual condition, size, or features. Even without state-specific rules, Article 12 provides a clear framework.
Your local MLS likely has specific rules about photo modifications. Common requirements include checking a 'virtually staged' box, adding specific disclosure text to remarks, or using watermarks. MLS violations can result in fines and listing removal—check your MLS handbook.
Even without a legal mandate, watermarking is an industry best practice that protects you from misrepresentation claims. Apply a semi-transparent 'Virtually Staged' watermark to each enhanced image, positioned where it won't be cropped by different platforms.
Keep high-resolution original photos for every property where you use virtual staging. If a buyer or inspector requests them, or if a complaint arises, having originals readily available demonstrates transparency and good faith practice.
Include a clear statement in your MLS remarks or property description noting that virtual staging has been used. Something like: 'Photos have been virtually staged to show the home's potential. Furniture shown is not included.' This creates a documented disclosure.
