Florida has no statewide virtual-staging-specific labeling format. Florida Statute §475.25 permits discipline for fraud, misrepresentation, concealment, and dishonest dealing. For Stellar MLS listings, add 'Virtually staged' to each photo description

Stellar MLS Article 04.04 requires that each virtually staged photo must include the words 'Virtually staged' in the photo description entry field. This is a per-photo requirement, not just a general listing disclosure.

Begin public remarks with required disclosure statement

Stellar MLS Article 04.04 requires public remarks to BEGIN with: 'One or more photo(s) was virtually staged.' This must be the first words—don't bury it mid-paragraph or at the end.

Follow Stellar MLS's exterior restrictions

For Stellar MLS listings, exterior virtual staging is prohibited except for adding unattached furniture or décor. Do not change landscaping, paint, structures, views, utility lines, or other property characteristics.

Tip: If you want to show outdoor potential, use traditional staging with physical furniture—just don't digitally enhance exterior shots.

Don't alter or remove permanent fixtures

Digitally removing water stains, hiding damage, changing flooring, or altering fixtures could create a misleading representation under Florida law. Stellar MLS separately prohibits altering permanent fixtures or negative property elements.

Tip: Think of it this way: staging adds moveable items to show potential. Anything that changes what the property actually is crosses the line.

Be especially careful with waterfront and pool properties

Florida's premium markets often revolve around water views and pool features. These high-value elements attract extra buyer scrutiny. Never digitally enhance water views, remove neighboring boats or docks, or alter pool condition. Misrepresentation of waterfront features is a common source of complaints.

Separate Florida law from MLS rules

Apply F.S. §475.25 as the statewide misrepresentation standard. Apply Article 04.04 only when the listing is governed by Stellar MLS, and check other Florida MLSs for their own requirements.
